Terms

Terms and conditions of service

Effective from 1 November 2026. The Polish version prevails.

§ 1. General provisions

  1. These terms set out the rules for using the Harmonia website and for the provision of the following services: hypnosis, guided meditation, EFT (tapping) and resilience training (the “Services”).
  2. The Services are provided by Mateusz Tybura as an unregistered business activity within the meaning of Art. 5(1) of the Polish Entrepreneurs Law of 6 March 2018 (Prawo przedsiębiorców) (the “Provider”). Postal address: Kraków. Contact: [email protected].
  3. The Services may only be used by a person who meets the conditions set out in § 3 (the “Client”).
  4. These terms are available free of charge on the website in a form that allows them to be downloaded, saved and printed. Sending a request requires reading and accepting these terms.

§ 2. Nature of the Services and the Provider's qualifications

  1. The Provider is not a psychologist, psychotherapist, psychiatrist or doctor, and does not hold a medical degree or a licence to practise any medical profession.
  2. The Services are intended to support mental well-being, relaxation and personal development. They are not psychotherapy, psychological help, diagnosis, treatment, rehabilitation or any other medical or healthcare service.
  3. The Provider does not diagnose, does not treat illnesses or disorders, does not recommend, change or stop any medication, and does not issue medical certificates, sick notes or referrals.
  4. The Provider is not a healthcare provider. The Services are not publicly funded healthcare services (they are not provided under the Polish National Health Fund, NFZ) and are not reimbursed.
  5. The Services do not replace advice from a doctor, psychologist, psychotherapist or psychiatrist, nor any treatment or psychotherapy the Client is receiving.
  6. Words used on the website such as “session” or “working with emotions” describe the form of the Services and do not mean therapy in a medical or psychotherapeutic sense.

§ 3. Who may use the Services

  1. The Services are available only to adults who are at least 18 years old, have full legal capacity and are able to make their own informed decisions.
  2. The Provider does not work with children or young people under 18 — even with the consent or in the presence of their parents or legal guardians.
  3. The Provider does not provide overnight, 24-hour, residential or accommodation-based services, does not act as the Client's carer and does not provide crisis intervention.
  4. The Services are provided in Polish, the Provider's native language, or in English, which the Provider speaks at B2/C1 level. Sessions in English may need moments to clarify meanings, and some nuances may need to be discussed in other words. The Client is asked to point out anything unclear straight away.
  5. The Services are based on conversation and voice work, so they require easy mutual understanding. To ensure the best quality, the Provider does not work with people who are not fluent in Polish or English, with people who have serious speech impairments, or with people whom the Provider cannot fully understand. The Provider strongly recommends that people who are not fluent in either language or who have medical conditions affecting their speech seek help from a specialist prepared for such situations.
  6. People with mental or physical health problems should first seek help from a doctor or another qualified professional and discuss with them whether to use the Services.
  7. Contraindications to hypnosis and EFT include in particular: psychosis, schizophrenia, borderline personality disorder, severe dissociation and other serious mental disorders, epilepsy, active trauma, a suicidal crisis, pregnancy, circulatory diseases and being under the influence of alcohol, drugs or other psychoactive substances.
  8. The Provider may refuse to start or may stop a session if there are contraindications, the Client is under the influence of alcohol or other substances, behaves in a way that endangers themselves or others, or there is doubt about their ability to take part consciously. The fee for any part of the Service not provided will be refunded.

§ 4. Client's declarations and obligations

  1. By sending a request, the Client declares that they: are at least 18 years old and have full legal capacity; have read and accept these terms; understand that the Services are not medical services, psychological help or psychotherapy; have none of the contraindications listed in § 3, or will inform the Provider about them before the session.
  2. The Client agrees to provide true information about their health that may be relevant to the safety of the Services and to promptly report any changes.
  3. The Client should not stop treatment, psychotherapy or medication without consulting their doctor or psychotherapist. The Provider never recommends doing so.
  4. If the Client is under the care of a doctor, psychologist or psychotherapist (e.g. for chronic pain, anxiety disorders or depression), they should inform them that they are using the Services. The Provider does not contact anyone involved in the Client's care without the Client's explicit written consent and does not require such consent.
  5. Taking part in the Services is voluntary. The Client may stop a session at any time.
  6. For online sessions, the Client ensures a quiet and safe place and does not take part while driving, operating machinery or in any other situation requiring full attention. After a hypnosis or meditation session, it is recommended to rest for a while before driving.
  7. The Client makes decisions about their health and life independently and at their own responsibility.

§ 5. Results of the Services and information on the website

  1. The Provider performs the Services with due care but does not guarantee any particular result. Results vary from person to person and depend, among other things, on the Client's commitment and their life and health situation.
  2. Content on the website, including service descriptions and answers to questions (FAQ), is for information only. It is not medical or psychological advice and is not a promise of any particular result.
  3. References to scientific research on the methods described are for information only and do not mean that a method is a recognised treatment or that it will produce a particular result for the Client.
  4. Reviews on the website are Clients' subjective accounts and do not guarantee similar results. The Provider sends review requests after a session through a private, single-use link, so only a person who has used the Services can add a review. Every review is checked before publication. The Provider rejects only reviews that break the law, contain personal data of third parties or offensive content, does not edit reviews, and does not post, commission or buy fake reviews.
  5. Information on the website is not an offer within the meaning of the Polish Civil Code, but an invitation to conclude a contract.

§ 6. Bookings, payments, cancellation and withdrawal

  1. The form on the website is used to send a request and is not a booking. The contract is concluded when the Provider confirms the appointment by email.
  2. The prices of the Services are given in the price list on the website and are final prices. The Provider runs an unregistered business activity and is not registered for VAT (subjective exemption under Art. 113(1) of the Polish VAT Act), so prices do not include VAT. Individual sessions are charged at an hourly rate: sessions in Polish in Polish złoty (PLN) and sessions in English in euro (EUR).
  3. The first 60-minute introductory conversation is free of charge and does not oblige the Client to use any further Services. The price of group meditations and resilience training is agreed individually and given to the Client before the contract is concluded.
  4. The price of a specific Service and the payment method are given in the appointment confirmation, before the contract is concluded.
  5. Payments are accepted online only, including for Services provided in person. Payment details and the payment deadline are given in the appointment confirmation.
  6. The Provider does not issue VAT invoices. At the Client's request made within 3 months from the end of the month in which the Service was provided or payment was received, the Provider issues a bill (rachunek, an invoice without VAT).
  7. The price of a session held in English is higher than that of a session in Polish because it requires additional preparation, in particular specialist vocabulary for physical and health conditions, taking into account the Client's cultural and religious context, and preparing materials in English. The price depends only on the language in which the session is held, not on the Client's citizenship, nationality or place of residence. A Client who speaks Polish fluently may choose a session in Polish at the standard price. The Client chooses the session language in the request form.
  8. The Client may cancel or reschedule a session by emailing the Provider at least 24 hours before it starts. Fees for later cancellation apply only if they were stated in the appointment confirmation.
  9. If the Client does not attend a confirmed session and has not cancelled it, the Provider may keep the fee for that session only if this rule was stated in the appointment confirmation. Otherwise the Client chooses a refund or a new date.
  10. A Client who is a consumer may withdraw from a distance contract without giving a reason within 14 days of its conclusion by sending a statement to the Provider's email address. If the Client asks for the Service to start before this period ends and the Service is fully performed, the right of withdrawal expires. If the Client withdraws after the Service has started, they pay for the part performed up to the withdrawal.
  11. If a session is to take place before the withdrawal period ends, the Client expressly requests that the Service starts before that period ends and acknowledges that they will lose the right of withdrawal once the Service has been fully performed — by ticking the corresponding box in the booking form or by email before the appointment is confirmed. The Provider confirms this request in the appointment confirmation.
  12. The appointment confirmation, sent by email, states the Service, the date, the price, the payment details and deadline, information about the right of withdrawal and the model withdrawal form from Annex 2 to the Polish Consumer Rights Act. The Client may use that form to withdraw — its use is optional.
  13. Refunds are made without undue delay and no later than 14 days, using the same payment method the Client used, unless the Client agrees to another method that costs them nothing.
  14. The Provider may cancel a session for important reasons. In that case the Provider offers a new date or refunds the fee paid in full.

§ 7. Confidentiality and personal data

  1. The Provider keeps the information provided by the Client confidential. Exceptions are situations where disclosure is required by law and situations of direct danger to the life or health of the Client or others — in such cases the Provider may notify the emergency services.
  2. Sessions are not recorded without the Client's explicit consent.
  3. The details from a request (name, email, phone, service, session language, date and message) are used only to contact the Client about the session. The Provider keeps them for 2 months after the preferred session date and then deletes them automatically. The Client may ask for them to be deleted earlier.
  4. To protect against spam, the Provider keeps a hash of the IP address from which a request was sent for up to one hour (Art. 6(1)(f) GDPR). The IP address itself is not stored.
  5. The Provider is the controller of the Client's personal data. Data are processed to handle requests and provide the Services (Art. 6(1)(b) GDPR), and health information only on the basis of the Client's explicit consent (Art. 9(2)(a) GDPR). The Client has the right to access, rectify, erase, restrict the processing of and port their data, to withdraw consent at any time and to lodge a complaint with the President of the Personal Data Protection Office (UODO).
  6. Review data (signature, text, rating and service) are processed on the basis of the Client's consent (Art. 6(1)(a) GDPR) and published until the consent is withdrawn — the review is then deleted.
  7. Data may be disclosed only to providers the Provider uses for website hosting, email and online payments — to the extent necessary and under data processing agreements. Data are not transferred outside the European Economic Area, are not sold or used for marketing, and are not subject to automated decision-making or profiling.
  8. Providing data in the form is voluntary but necessary to handle the request. The Client may object to the processing of the IP address hash (legitimate interest).
  9. The booking form is not meant for health information. Health information shared during sessions is processed only with the Client's explicit consent. Session notes, if kept, are stored encrypted, are not shared with third parties and are deleted at the Client's request.
  10. The website stores one cookie, NEXT_LOCALE, which remembers the chosen language (for up to 1 year). It is necessary to remember that choice and is not used for tracking. The website uses no analytics or advertising tools.

§ 8. Liability

  1. The Provider is liable for the proper performance of the Services under the applicable law.
  2. To the extent permitted by law, the Provider is not liable for the consequences of: concealing or giving false information about the Client's health; taking part in the Services despite contraindications or against medical advice; the Client stopping treatment or medication; decisions made independently by the Client; technical problems on the side of the Client or their internet provider.
  3. Nothing in these terms excludes or limits the Provider's liability to the extent that it cannot be excluded or limited by law (in particular for personal injury and intentional damage), nor limits the rights of a Client who is a consumer.

§ 9. Emergencies

  1. The Provider does not provide help in emergencies and does not provide crisis intervention.
  2. If your life or health is at risk, call the emergency number 112.
  3. In a mental health crisis you can get free help in Poland: the Support Centre for adults in mental crisis — 800 70 2222 (24/7) or the Helpline for Adults — 116 123.

§ 10. Complaints

  1. Complaints about the Services can be sent to the Provider's email address. A complaint should include the Client's contact details and a description of the issue.
  2. The Provider responds to a complaint within 14 days of receiving it.
  3. A Client who is a consumer may use out-of-court dispute resolution, for example the help of a municipal or district consumer ombudsman (rzecznik konsumentów) or the Voivodeship Inspectorate of Trade Inspection (WIIH).

§ 11. Final provisions

  1. Matters not covered by these terms are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on Providing Services by Electronic Means. The choice of Polish law does not deprive a Client who is a consumer of the protection of the mandatory provisions of the country where they habitually reside. Disputes are settled by the common courts competent under general rules.
  2. The Provider may change these terms for important reasons, in particular a change in the law or in the scope of the Services. Changes do not apply to sessions confirmed before they take effect.
